Can business accounts use the music library on instagram legally?

Hi there, I'm from Germany, where I've seen quite some creators get into legal problems (with fines of a few 1000€) because they used music on their videos.

I have a business account on TikTok and insta. On tiktok, the music library for business accounts is very small, and only has copyright free music, which I use.

On instagram, the library on a business account is WAY bigger, even with a lot of pop hits. Which I have used in the past, because i thought it had the same rule as tiktok: as long as it's in the business accounts music library, it's safe to use.

So now I am wondering: Do I need to delete those to be safe? there is so much conflicting advice on this!

Yeah this confuses a lot of people tbh. Just because Instagram shows the music doesn’t automatically mean you’re fully safe, especially for business use. Organic posts are usually fine, but it can get tricky if you’re promoting or running ads. If you want zero risk, stick to the commercial music library or properly licensed tracks.

no. from a commercial standpoint you can never use copyrighted music. the only way to do it is by getting distribution rights which usually means going through the label and the artist who owns the track

that’s why for brands companies or businesses using copyrighted music has always been strictly prohibited. that’s literally the point of copyright

if some random creator used copyrighted music and then ran it as an Ad that’s basically asking for a lawsuit because there was no prior agreement with the label for commercial distribution to sell or promote something

if it’s organic content for a creator or normal user there’s no issue. for a brand, company or even a small business this will never be an option because there’s always a commercial intent behind it like selling or promoting

it’s always better to use libraries that are 100% copyright free (there are paid platforms too if you want something a bit more “unique”)

Legally speaking you can use their music, but you cannot spend or make money from anything you upload. It has be for personal use exclusively.

the specificity point especially hits. every time i try to “broaden” a hook it performs worse, but when it feels almost too niche it somehow pulls more people in

Any people that runs 100 to 10k followers pages (any social media)?

Hey all, I own a business that involves many clients that promote their product, art or website with TikTok (also Instagram, Youtube and Facebook). I want to offer them a way to post their content, or to get content created and posted for them on existing TikTok pages. Basically you got pages in a specific theme (sport, anime, cinema, culture, memes...) and you rent it for a specific period of time. You get paid every month, and all you have to do is basically connecting the account once to our system. You can opt-out anytime you want, you keep the full ownership of the account. That's basically a way to monetize your pages passively. For now I'm doing it myself with my own pages (3 tiktok pages with 500 to 3k followers, and 1 6k subscribers Youtube channel), I made around $800 renting these for less than a month.
