First of all, is a go pro at a water park with mostly kids necessary? He was walking around with it for a while and at this point our group was already discussing what to do.
We ended up brining it up to staff and they said they can't do anything about it because they can't prove he was actually recording.

Nah I would go to someone who works there and say there’s a guy filming kids. Lots of waterparks, pool clubs etc have rules about filming.
If you can't tell whether or not the camera is on, then it's just straight up inappropriate to be wearing the camera in a public place full of children in swimsuits. They don't have to kick the guy out or arrest him, just tell him that he can't walk around with a camera pointed at all the other guests whether it's on or not. Very disappointing that they felt they couldn't take action.
This is one of the moments where people should be mad that the person pulled out their phone to record instead of doing something.
