Small fashion publication - what are the actual working norms for using brand campaign images?
I run a small independent fashion and culture publication (Instagram-based for now) covering the Jordanian creative scene. Based in Jordan, so not US jurisdiction.
I want to make a short video essay about a Louis Vuitton campaign that was shot in my country in 2021 - the argument being that the location was Jordanian but none of the credits were. To do that I'd use the campaign stills from the brand's own website and from their instagram profile, animate them myself, and layer my own commentary on top. Full credit on screen: house, campaign name, year, photographer.
What I'm trying to understand isn't "is this legal" so much as what publications actually do in practice:
-
Do editorial outlets typically seek permission for campaign imagery, or is credited editorial use just accepted because brands want the coverage?
-
Is there a meaningful difference between stills and screen-recorded brand video, in terms of takedown risk?
-
Is there a standard credit format that signals "editorial commentary" rather than "repost"?
-
Has anyone here actually had a problem doing this?
Any experience appreciated - I'd rather learn the norms now than after a takedown.
