I assure you the rate at which kids in America would do this is similar to any place these are sold. America simply made the wise decision to prohibit non-edible items being hidden inside food, for obvious reasons

Kinder Eggs aren't banned here.

Back in the 80s or 90s (I forget), someone choked on some toy, I don't think it was a kinder egg, and legislators pass a bill were any edible items can't have non edible items inside. Thus ended prizes in cereal, cracker jacks, etc. Now you can have prizes OUTSIDE the package (toys in cereal boxes but outside the plastic). King Cakes with the baby inside are now sold with the baby outside and you have to put it in.

Kinder Eggs were never banned, they just switched to candy inside the eggs.

Now you may ask "wait, fortune cookies have paper inside". Another fun fact, that paper is edible grade.

So now you know facts from myth/urban legend.

I was in Germany in the mid 90's and Loved buying, Kinder eggs. They had some great toys inside.
