The guy filming is right. He is protected by the first amendment. If you’re in public you can be filmed without asking permission. However, people think you need to ask for permission and you don’t when you’re in a public place.

I hate the arrogance of Russians thinking their laws apply in a different country. I come across a lot of Russians in my wife’s home country and they’re exactly the same there, but worse actually because it’s a smaller country that is partly occupied by Russia.
